The cryotherapy wellness training program license is billed once and provides a lifetime limited license to access the content. Right To Modify Terms & Conditions

Precision Equine Cryotherapy reserves the right to modify these Terms and Conditions at any time. Users will be notified of significant changes via email to the address associated with their account or through a prominent notice on our website at least 1 days before such modifications take effect.

Notification Of Security Breach

In the event of a security breach potentially affecting user accounts, we will:

• Notify affected users via email within 72 hours of discovering the breach

Failure to accept updates within 30 days of notification may result in restricted access to the platform and its current content.

Code Of Conduct

Consequences for non-compliance with the Code of Conduct may include:

• Written warning

• Temporary suspension of platform access

• Permanent termination of service without refund

• Potential legal action for severe violations

Users are solely responsible for all activities conducted through their account, whether authorized or unauthorized, and will be held accountable for any actions taken using their account credentials. The specific consequence will be determined based on the nature and severity of the violation, at the sole discretion of Precision Equine Cryotherapy.

Data Processing Subprocessors

Precision Equine Cryotherapy may engage third-party subprocessors to support the delivery of our digital training program. All subprocessors are vetted and required to maintain the same data protection standards as Precision Equine Cryotherapy. Some of our subprocessors are:

Each subprocessor is contractually obligated to:

• Comply with applicable data privacy regulations

Our total liability is limited to the amount paid for the Cryo-Kit Starter Training Package. We do not guarantee uninterrupted or error-free service and shall not be responsible for any damages resulting from the use or inability to use our digital materials.

Uptime Disclaimer

Precision Equine Cryotherapy guarantees a minimum of 99.5% uptime for the digital training program, excluding scheduled maintenance and force majeure events. In the event that monthly uptime falls below 99.5%, users may be eligible for service credits or compensation as detailed in our Service Level Agreement.

Claims from using the Cryo-Kit Starter Training Package must be filed within one month of the incident. Claims after this period are time-barred.

Updates will keep the Digital Training Program current with new features and security improvements. Documentation detailing changes will be available on our support portal and emailed to registered users.

Scope Of Support

Support services are available Monday through Friday, 9:00 AM to 5:00 PM Pacific Standard Time, excluding holidays. Support is limited to resolving access and functionality issues within our platform. Cosmetic issues or user errors are not supported. Previous versions of content are not supported after a new update; users must then migrate to the latest version.

In the event of a support inquiry, Precision Equine Cryotherapy commits to an initial response within 7 business days of submission. If the initial technical support does not resolve the issue, the following escalation procedure will be implemented:

(1) If the initial support representative cannot resolve the issue, the case will be escalated to a senior technical support specialist within 4 business hours.

(2) If the senior specialist cannot resolve the issue within 1 business day, the matter will be escalated to the technical support manager.

(3) The technical support manager will review the case and provide a comprehensive resolution or alternative solution within 2 business days.

(4) If the issue remains unresolved, the customer will be offered a full consultation with the company's lead technical expert or a pro-rated refund for the affected services.

Support Escalation Procedures

• If a support representative cannot resolve your problem, it is escalated to a senior support specialist.

• If unresolved within 3 business days, it is escalated to the technical support manager.

• Unresolved issues may qualify for a refund or service credit per our Refund Eligibility Conditions.

Equipment and Tools

Your purchase includes physical tools and equipment necessary for practical application, shipped to your address after payment confirmation. Shipment tracking will be provided once dispatched. The Cryo-Kit Starter Training Package is a one-time purchase with a fixed price, including digital content and physical equipment with full access upon payment. Additional equipment, replacements or products can be purchased on a singular basis from our online store.

Renewal and Access Policy

This is a one-time purchase for permanent access to course materials with no automatic renewals. Users retain lifetime access after the initial purchase.

Orders for the Cryo-Kit Starter Training Package are processed within 7 business days after payment confirmation. Shipping times may vary by location, and any delays will be communicated as they become known.

Payment for the Cryo-Kit Starter Training Package is required in full at the time of purchase, with no recurring billing. Acceptable payment methods include major credit cards (Visa, MasterCard, American Express), PayPal, and bank transfers.

The digital training program is available as a one-time annual license fee. The fixed-rate payment provides access to all materials for 12 months, with different package tiers offering varying content and support levels. Pricing is displayed at purchase.

Return & Refund Policy & Restrictions:

• No refunds will be issued after the 24-hour cancellation period.

• Digital training materials are non-refundable due to immediate content access and the digital nature of the program.

• Physical equipment and tools are non-refundable except in cases of damage or manufacturer defects upon arrival.

• Refunds will not be processed for:

a) Buyer's remorse.

b) Partial use of digital content.

c) Subjective dissatisfaction with training materials.

d) Personal circumstances preventing use of the product.

• All refund requests are subject to final approval by our customer service team.

• After 14 days from the original purchase date, no refunds will be considered under any circumstances.

Due to the digital format of the training materials and the immediate access provided upon purchase, REFUNDS ARE NOT OFFERED. When eligible, refunds will be calculated as follows:

• For digital content, a full refund will be issued if access issues cannot be resolved within 14 days.

• For physical equipment, a refund will be calculated based on the situation of the product, less a standard processing fee of 10% plus any incurred shipping restocking fee’s or other. If the item is defective it can be replaced through the manufacturer.

• All refund amounts will be processed using the original payment method or as store credit at the company's discretion.

All refund requests must be submitted in writing to our support team within 14 days of the original purchase date, accompanied by proper documentation of the issue. Exceptions are limited to the aforementioned conditions.

Refund Eligibility Conditions

• Manufacturing Defects: Products with manufacturer defects identified within 14 days of delivery may qualify for replacement or refund.

• Technical Issues: Unresolvable digital content access problems reported within 14 days of purchase may be eligible for a refund.

Intellectual Property Rights

Precision Equine Cryotherapy reserves the right to modify the license terms at any time, with such modifications becoming effective immediately upon notification to the user via email or through the digital platform. Users will be notified of any changes to the license terms, and continued use of the training materials after such notification constitutes acceptance of the modified terms. Where third-party intellectual property is included, a comprehensive list of such third-party content and its specific usage terms is attached as Appendix A to this agreement. This list details each third-party element, its source, and the precise terms under which it is used, including any licensing restrictions or attribution requirements.

In the event of an intellectual property infringement claim against Precision Equine Cryotherapy or the User, the following process shall apply:

a) The party receiving notice of a potential infringement claim shall promptly notify the other party in writing;

b) Precision Equine Cryotherapy shall have the right to defend, settle, or mitigate any such claim at its sole discretion;

c) The User shall provide full cooperation in any such defense or settlement process;

d) If the intellectual property becomes subject to a third-party claim, Precision Equine Cryotherapy may, at its option, obtain a license, replace or modify the content, or terminate the license with a pro-rated refund. In no event shall the total liability of Precision Equine Cryotherapy exceed the total amount paid by the user for the Cryo-Kit Starter Training Package.

Users agree to maintain the strict confidentiality of all proprietary materials provided in the Cryo-Kit Starter Training Package. Sharing, disclosing, or permitting access to any of the training materials, content, or intellectual property to any third party is prohibited. Any breach of this confidentiality obligation may result in immediate termination of the license and potential legal action to protect intellectual property rights.

Do not share your account credentials or use multiple devices simultaneously.

Reverse Engineering Policy

Reverse engineering, decompiling, disassembling, or attempting to derive the source code or underlying algorithms of the digital content is not permitted. This license is restricted to use within the country of purchase and is intended for personal computing devices owned by the licensed user. The license is non-transferable and may not be sublicensed to any third party. Any breach of these terms or attempts to reverse engineer or deconstruct the digital content will result in immediate termination of access and potential legal action.

User License

You are granted a non-exclusive, single-user license to access and use the training materials for personal, non-commercial use only. This license is limited to:

• One (1) user account

• A maximum of two (2) personal computing devices

• Simultaneous login on only one device at a time

Account Sharing

Sharing account credentials or accessing the platform from multiple devices simultaneously is not allowed. Reverse engineering, decompiling, disassembling, or attempting to derive the source code or underlying algorithms of the digital content is strictly prohibited. The license is non-transferable and may not be sublicensed to any third party. Any violation of these terms will result in immediate termination of access and potential legal action.

Account Creation

Upon purchase, creating a user account is required to access and use the training materials. Account creation is mandatory for personal, non-commercial use of the digital training program. We collect the following personal data during registration: full name, email address, phone number, and device information. We comply with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other relevant regional data protection regulations. We collect, process, and protect personal information in full compliance with these laws, ensuring user privacy and data security.

Authentication Process

• Users must create a unique username and a strong password meeting our security guidelines (minimum 12 characters, including uppercase, lowercase, numbers, and special characters).

• Multi-factor authentication (MFA) is mandatory for all user accounts. Upon login, users will be required to:

a) Enter their username and password

b) Provide a second form of verification, which may include:

- A time-based one-time password (TOTP) generated by an authenticator app

- A code sent via SMS to the registered phone number

You must not use the training materials in ways that harm Precision Equine Cryotherapy's reputation. We may terminate your access if you engage in harmful activities.

Comply with all relevant laws when using the Cryo-Kit Starter Training Package; non-compliance may result in termination of access. This includes operating under veterinary supervision.

The license is perpetual from purchase but can be terminated for violating these Terms and Conditions. Technical support and maintenance services may end if you:

Intellectual Property

Precision Equine Cryotherapy retains full ownership of all intellectual property rights associated with the digital training materials. Users are required to maintain and preserve all existing copyrights, trademarks, and attribution forms as they appear in the original materials. Removal or alteration of copyright information is strictly prohibited.

Precision Equine Cryotherapy grants a non-exclusive license to the user for the digital training materials. This non-exclusive license permits the user to:

• Access the digital materials through the designated platform.

• View and use the content for personal training purposes.

License Scope

The user is granted a limited, non-exclusive, non-transferable license to access and use the digital product for personal, non-commercial purposes only. Specifically permitted uses include:

• Viewing the digital content for personal reference.

• Storing a single copy for personal backup.

• Using the content for personal study or research.

Prohibited actions include reproduction, distribution, commercial use, modification, or creating derivative works. Sublicensing of the digital product is strictly forbidden. Any unauthorized use, including sublicensing, will result in immediate license termination and potential legal action. The user does not have any exclusive rights to the digital products.

Termination by Precision Equine Cryotherapy

• Violation of any Terms and Conditions.

• Unauthorized sharing or misuse of content.

• Activities that damage the company's reputation.

Termination by the User

• Discontinuation of service due to material breach by Precision Equine Cryotherapy.

• Inability to access purchased materials through no fault of the user.

• Failure to provide promised digital or physical materials as described in the original purchase agreement.

Termination by either party shall result in

• A written notice period of 7 days prior to account termination.

• Immediate cessation of access to digital training materials.

• Deletion of downloaded content.

• Potential legal action for substantial breaches.

The following obligations persist after account termination:

a) Intellectual property rights in Section 6,

b) Confidentiality of content,

c) Payment obligations, and

d) Liability limitations.

These conditions remain binding regardless of account status changes, including confidentiality and usage restrictions, which continue indefinitely. The license granted is perpetual from purchase but can be terminated immediately if these Terms and Conditions are violated. It remains valid as long as all terms are met and the original purchase is maintained in good standing.
